Artificial intelligence tools are rapidly becoming part of everyday work across industries. Employees are using AI for writing, data analysis, coding, customer service, and decision-making — sometimes without their employer's knowledge or approval. Why You Need an AI Policy Now

The adoption of generative AI tools like ChatGPT, Claude, Gemini, Copilot, and industry-specific AI platforms has outpaced most companies' policy frameworks. Employees are using AI to draft emails and documents, summarize meetings, generate code, analyze data, create presentations, and interact with customers.

Your policy should prohibit employees from entering the following into any AI tool that is not explicitly approved for handling such data: personally identifiable information (PII) of employees, customers, or clients, protected health information (PHI) under HIPAA, financial data subject to SOX, PCI-DSS, or other regulations, trade secrets and proprietary business information, attorney-client privileged communications, and source code or intellectual property.

Data Retention and Third-Party Access

Explain that data entered into AI tools may be stored, used for training, or accessed by the tool provider depending on the terms of service. This is why only approved tools with vetted data handling policies should be used.

Intellectual Property Considerations

AI raises complex intellectual property questions. Your policy should address ownership of AI-generated content created by employees during work, whether AI-generated work product is eligible for copyright protection (the U.S. Copyright Office has stated that purely AI-generated content without human authorship is not copyrightable), the risk of AI tools reproducing copyrighted material from training data, and your company's position on disclosing AI assistance in work product.

AI in Hiring and Employment Decisions

Several jurisdictions have enacted or proposed laws regulating the use of AI in employment decisions.

New York City Local Law 144

NYC Local Law 144 requires employers who use automated employment decision tools (AEDTs) in hiring or promotion to conduct annual bias audits, publish audit results, and provide notice to candidates and employees. If you operate in New York City and use AI-assisted screening, scoring, or ranking tools, your handbook should address compliance with this law.

Illinois AI Video Interview Act

The Illinois Artificial Intelligence Video Interview Act (820 ILCS 42) requires employers who use AI to analyze video interviews to notify applicants, explain how the AI works, and obtain consent before using AI analysis. Your handbook should reference compliance if applicable.

EEOC Guidance

The EEOC has issued guidance stating that employers are responsible for the discriminatory impact of AI tools they use in employment decisions, even if a third-party vendor built the tool. If your AI screening tool disproportionately screens out candidates of a particular race, sex, age, or disability status, you may be liable under Title VII or the ADA. Your policy should address who is authorized to select and deploy AI tools in HR processes and the requirement for bias testing.

Human Review and Accountability

Your policy should establish that AI outputs must be reviewed by a human before being used in business decisions, particularly for decisions affecting employment (hiring, firing, promotions, compensation), customer-facing content and communications, legal, regulatory, or compliance matters, and financial analysis and reporting.

Establish clear accountability: the employee who uses the AI tool is responsible for the accuracy and appropriateness of the output, not the AI.

Transparency and Disclosure

Your policy should address when employees must disclose that AI was used. Consider requiring disclosure when AI-generated content is presented to clients or customers, in regulatory filings or legal documents, and in published research or external communications.

Training

Employees need training on your AI policy. Cover what tools are approved and how to access them, what data can and cannot be entered, how to evaluate AI outputs for accuracy and bias, the company's expectations for human review, and how to report concerns about AI use.

Keeping the Policy Current

AI technology and regulations are evolving rapidly. Your AI policy should be reviewed at least every six months — more frequently than most other handbook policies. Monitor new state and federal AI regulations, updates to approved tools' terms of service, and emerging risks identified by your legal, IT, and compliance teams.
